Quick Summary

China’s strictest ever new regulations on food delivery officially take effect on June 1, 2026, released by the State Administration for Market Regulation. The core target of the new rules is the long-unresolved issue of "ghost restaurants" — unregistered or non-existent food delivery merchants. Ordinary consumers will gain multiple layers of food safety protection and clear, actionable guidance for ordering food online.

1. All food delivery merchants are required to disclose their true operating information: the name of the physical store must match the online store name, merchants without in-person dining must display a clear "no dine-in" label. All qualification documents are subject to on-site verification by platforms and cross-checking with regulator data, with updates required every six months. This lets consumers clearly see a merchant’s true status and avoid unlicensed ghost merchants.

2. The new rules clarify consumer rights protection: Merchants must seal all delivery packaging with tamper-evident, non-resealable seals. If consumers receive an order with a broken seal, they can refuse delivery directly, and platforms will intervene to clarify liability and protect consumer rights.

3. When ordering, consumers can prioritize merchants labeled with "open kitchen" (Mingchu Liangzhao), which allow public view of their kitchen operations for stronger food safety guarantees. The new rules also introduce a food delivery rider supervision mechanism, which greatly reduces room for non-compliance and significantly improves overall consumer safety.

The implementation of the new food delivery regulations reshapes the industry’s competitive landscape, bringing new development opportunities for legitimate brand owners while also setting new compliance requirements.

1. On the industry level, China’s food delivery market has already surpassed 1.8 trillion yuan in size, with orders under 15 yuan accounting for roughly 40% of total volume. In the past, information asymmetry allowed unregulated merchants to squeeze out compliant businesses through low prices and low-quality offerings. By raising the industry-wide compliance threshold, the new rules will break the "bad money drives out good" dynamic, refocus competition on product quality and service, and further amplify the advantages of legitimate brands.

2. In terms of channel traffic, the new rules require platforms to tie traffic allocation to merchant compliance status. Compliant merchants with open kitchen systems will receive traffic and cash incentives from platforms, while non-compliant merchants will be removed from platforms. Brand owners can seize this opportunity to complete compliance upgrades early and capture the market share vacated by exiting non-compliant operators.

3. For brand building, legitimate brand owners can leverage their compliant status to build their reputation around food safety, rebuild consumer trust, and command higher brand premiums and stronger user loyalty.

The new regulations set clear requirements for compliant operation for food delivery sellers, releasing new market opportunities while also highlighting clear risks. Sellers need to adjust their operating strategies in a timely manner.

1. Core policy requirements: Sellers must hold valid and authentic operating qualifications, ensure their online store name matches their offline physical store signage, display a prominent "no dine-in" label on their store homepage if they offer no dine-in or self-pickup services, and use qualified tamper-evident delivery seals. Violations including using false qualifications to join platforms carry a maximum fine of 200,000 yuan. Intentional violations can also result in fines equal to 1 to 10 times the responsible person’s annual personal income, making non-compliance extremely high-risk.

2. Market opportunities: Large numbers of non-compliant ghost merchants will be removed from platforms, freeing up market share. Compliant sellers will gain greater consumer trust and preferential traffic allocation from platforms. Many local governments have already launched support policies including free installation of open kitchen monitoring equipment and free distribution of delivery seals. Meituan also offers traffic and cash subsidies for compliant merchants to lower compliance costs.

3. Risk reminders: Platforms will verify and update merchant information every six months. Sellers must update their qualifications in a timely manner, avoid complacency, and complete compliance upgrades as soon as possible to avoid being removed from platforms and penalized.

The implementation of the new food delivery regulations brings new market demand and business opportunities for catering-related manufacturing factories, while also offering insights for digital transformation.

1. Product design and production demand has shifted noticeably: The new rules require millions of food delivery merchants to complete compliance upgrades. On one hand, large numbers of merchants need to install open kitchen monitoring equipment; on the other, all merchants must use qualified non-resealable tamper-evident delivery seals. Currently, more than 400,000 merchants across China have already activated open kitchen systems, and large numbers of small and medium-sized merchants (SMBs) still have unmet demand for upgrades. Factories can develop cost-effective small monitoring devices and bulk seal products tailored to the low-cost needs of SMBs.

2. Clear business opportunities: A unified national cost-sharing mechanism has not yet been established, leaving large unmet demand for low-cost procurement among SMBs. Factories can partner with local governments and food delivery platforms to supply products in bulk and expand market share.

3. Insights for transformation: Leading platforms are already using AI technology to audit merchant qualifications and identify fake storefront photos. Factories can also advance digital production and intelligent upgrades to improve capacity efficiency and better meet the bulk customization needs of platforms and merchants.

The new food delivery regulations push the industry into a new stage of compliance-based regulation, generating a large volume of new service demand and opening up new development space for relevant service providers.

1. Industry development trend: Online catering regulation has shifted from formal document review to penetrative oversight, with industry-wide compliance requirements rising sharply. Platforms, merchants, and regulators all have new service demand, the industry as a whole is moving toward greater transparency and compliance, and the relevant service market will expand rapidly.

2. Core customer pain points: Small and medium-sized merchants struggle to afford the additional costs of open kitchen equipment and compliant delivery seals. Platforms need to complete on-site verification and regular qualification checks for millions of merchants nationwide, while also addressing challenges around fake business licenses and AI-generated fake storefront images. Regulators also need additional technical and human support for routine oversight.

3. Direction for solutions: Service providers can offer services such as open kitchen equipment leasing and bulk low-cost compliant packaging supply for SMBs to lower their compliance costs; they can also provide platforms with technical services including AI-powered qualification verification and fake storefront identification, and take on third-party merchant verification business to meet the needs of platforms and regulators and expand their own business scope.

The new regulations set extremely high requirements for the operation and management of online catering platforms, clarify platform liability, and require platforms to adjust their operating strategies to effectively mitigate regulatory risks and capitalize on industry upgrade opportunities.

1. New rules clarify platform compliance requirements and risks: The new regulations require platforms to conduct substantive on-site verification of all merchant qualifications, cross-check data with provincial-level regulatory authorities, update merchant information every six months, and disclose all required compliance labels. Failure to fulfill auditing duties carries a maximum fine of 100,000 yuan, and relevant responsible persons may also face liability. Previously, 7 major platforms were fined a total of 3.597 billion yuan for ghost restaurant violations, with relevant responsible persons also penalized, making compliance risk extremely high.

2. Direction for operational adjustment: Platforms can tie traffic allocation to merchant compliance status to force merchants to complete compliance upgrades, and can also adopt AI technology such as Meituan’s Xingmou large AI model for food safety to lower auditing costs and improve auditing efficiency. At the same time, platforms can build incentive mechanisms for rider supervision, leveraging riders’ offline presence to expand the oversight network and reduce verification costs.

3. Key points for risk mitigation: Platforms need to establish long-term auditing and verification mechanisms rather than superficial checks, and coordinate with local regulators to enable cross-region action against non-compliant merchants, removing unqualified operators in a timely manner to avoid triggering regulatory penalties.

The implementation of China’s strictest ever food delivery regulations marks a major shift in the country’s online catering regulation, provides new directions and research samples for industrial research, and carries important research value.

1. New industry trends: China’s food delivery market has already surpassed 1.8 trillion yuan in size, has more than 600 million consumers, and low-priced orders now account for 40% of total volume. The industry’s original "low price, low quality" development model that allowed bad money to drive out good is no longer sustainable. Regulation has entered a new stage of penetrative multi-stakeholder governance, and the industry ecosystem is facing rebalancing.

2. Outstanding unanswered research questions: A number of problems remain to be addressed after the regulations take effect, including how to complete full-coverage on-site verification for millions of merchants nationwide, how to share the compliance cost burden for small and medium-sized merchants, how to roll out national support policies, and how to ensure sustained enforcement. All of these require further follow-up observation.

3. Policy and research implications: The new regulations establish a multi-stakeholder governance framework that includes platforms, merchants, riders, regulators and consumers, and for the first time holds individual persons liable for violations. It重构行业竞争逻辑 from the institutional level, and provides important reference value for research on internet catering regulation and platform economy governance. Further research on the long-term implementation mechanism and long-term industrial impact of the new regulations is well worth pursuing.
